TERMS OF SERVICE

1. About these terms

Welcome to Coffee Searer. This store is operated by Rumbling Rock LLC, doing business as Coffee Searer. In these Terms of Service, “Coffee Searer,” “we,” “us,” and “our” refer to that business.

These terms govern your use of our website and purchases of our products and services. Our store is powered by Shopify.

Please review these terms before placing an order. By placing an order and accepting these terms, you agree to them, together with the applicable product, delivery, subscription, and other terms disclosed before purchase. Our Return and Refund Policy forms part of these terms. Our Privacy Policy explains how personal information is handled.

Nothing in these terms limits rights or remedies that cannot lawfully be excluded.

2. Customer information and accounts

To place an order, you must be legally able to enter into a purchase agreement and authorized to use the payment method provided. If you order on behalf of a business or organization, you must have authority to do so.

Please provide accurate and current contact, payment, billing, and delivery information. Keep your account credentials secure and notify us promptly if you suspect unauthorized use of your account.

3. Products and availability

We aim to describe our products accurately. Coffee is an agricultural product, and its appearance and flavor can vary between harvests, batches, roast levels, storage conditions, and brewing methods. Tasting notes describe sensory characteristics and do not mean that those ingredients have been added unless the product description says so.

Seasonal offerings may change as described on their product pages. We will not substitute a materially different product for a specifically identified item without your agreement.

We may update product descriptions, discontinue products, or limit quantities for future orders. These changes do not remove our obligations for orders already accepted.

4. Orders, prices, and payment

Review your product selections, quantities, roast options, purchase frequency, and delivery details before submitting an order.

Prices and the applicable currency are displayed on our store. Applicable taxes and shipping or delivery charges are shown before you complete your purchase. Prices and promotions may change for future purchases. Changes to existing subscriptions are addressed separately below.

You authorize us and our payment providers to collect the charges you approve at checkout. A one-time purchase does not enroll you in a subscription.

We may decline, limit, or cancel an order for legitimate reasons, including unavailable stock, unsuccessful payment, suspected fraud, or a material pricing or listing error. We will notify you if this affects your order. If we cancel an order after collecting payment, we will refund the cancelled items and associated charges.

We will seek your agreement before increasing the amount charged for an order already placed or making a material substitution.

5. Coffee subscriptions

Subscriptions renew automatically and generate recurring charges at your selected interval until you cancel.

When you expressly select and approve a subscription, you authorize recurring charges to your selected payment method at the price and frequency disclosed when you subscribe, subject to changes communicated as described below.

Your subscription confirmation will include your subscription details and information about managing or cancelling it.

You may pause or cancel online using the subscription-management link provided with your subscription. You may also contact info@coffeesearer.com for assistance or to request cancellation. There is no cancellation fee.

Cancel before your next scheduled charge to prevent that renewal. Cancellation stops future renewals; it does not automatically cancel or refund an order already charged. Requests concerning an existing order are handled under our Return and Refund Policy.

We will provide advance notice of material subscription changes, including price changes, and explain how to cancel before they take effect. We will provide required renewal notices and annual subscription reminders in accordance with applicable law.

6. Shipping and local delivery

Available destinations, local delivery areas, minimum order amounts, order deadlines, and fulfillment schedules are described on our store and in the information provided with your order.

Free local delivery applies only to eligible orders and addresses within our stated service area. It does not automatically apply to shipped orders.

Please provide a complete address and any necessary delivery instructions. If incorrect information or lack of access prevents delivery, we will contact you about available options. Any additional charge for redelivery or reshipping must be disclosed and agreed to before it is incurred.

Carrier transit times are estimates unless expressly guaranteed. If a material delay or fulfillment problem occurs, we will communicate with you and provide any cancellation or refund options required by law.

For a missing, damaged, or incorrect delivery, please contact us using the process in our Return and Refund Policy.

7. Returns, refunds, and order cancellations

Our Return and Refund Policy explains how we handle damaged, incorrect, missing, or defective products, taste concerns, cancellation requests, and approved refunds.

We do not accept physical returns or exchanges of coffee or beverages. This does not prevent refunds or replacements for qualifying order problems.

Please contact info@coffeesearer.com promptly if you need to change or cancel an order. Changes and cancellations cannot be guaranteed once roasting, preparation, or fulfillment has begun. Approved cancellations will be refunded.

8. Business, wholesale, and event orders

Businesses and organizations may purchase from our store.

Wholesale arrangements, event services, and other custom orders may have additional written terms, such as quantities, delivery arrangements, payment schedules, or cancellation conditions. We will disclose these before you commit to the order. Additional terms that we both accept govern that particular order where they conflict with these general terms, subject to applicable law.

An inquiry alone does not reserve an event date or delivery time.

9. Relationship with Shopify

Coffee Searer is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Coffee Searer. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Coffee Searer, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Coffee Searer.

For this section, “Services” means our store and website, including their related content, features, tools, products, and services. This section applies only to the extent permitted by applicable law.

10. Privacy and third-party services

Our Privacy Policy explains how we collect, use, and share personal information, including through Shopify and other service providers. Shopify’s handling of personal information is also described in Shopify’s Privacy Policy.

Our website may include payment services, applications, or links provided by third parties. Their services may be subject to their own terms and privacy policies. We do not control independent third-party websites. Their involvement does not remove our obligations to fulfill your order or provide remedies required by law.

11. Website content and customer reviews

Our original text, photographs, videos, logos, and other website materials are owned by us or used with permission. You may browse and link to our public pages for lawful personal or business purposes. Other uses of protected material require permission unless permitted by law.

You retain ownership of reviews or other content you submit. When you submit content for public display, you give us a nonexclusive, royalty-free license to display, reproduce, and share it in connection with our store and its promotion, without materially changing its meaning.

Please submit only content you have the right to share. Reviews must reflect your honest experience, and any incentive or compensation must be disclosed.

We may remove content that is fraudulent, unlawful, threatening, infringing, unrelated, or spam. We do not prohibit honest negative reviews. We will not publish your private customer-service correspondence as a testimonial without your permission.

12. Acceptable use

You may not use our website to commit fraud, impersonate another person, submit unauthorized payments, threaten or harass others, distribute malware, unlawfully collect personal information, or interfere with the website’s operation.

You may not bypass security controls or use automated tools in a way that violates applicable access restrictions or disrupts the store.

We may restrict access or suspend an account where reasonably necessary to address fraud, security risks, or material violations of these terms. This does not eliminate any refund or other obligation we owe you.

13. Website availability and warranties

We aim to keep our website accurate and available, but we cannot promise uninterrupted or error-free operation. We may temporarily suspend website features for maintenance or other operational reasons.

To the extent permitted by law, website features and general educational content are provided “as available,” without additional warranties beyond those expressly stated.

This does not disclaim the product descriptions or express promises on which your purchase is based, our Return and Refund Policy, or any warranties and consumer protections that apply by law.

14. Limitation of liability

To the extent permitted by law, Coffee Searer will not be liable for indirect or consequential losses, such as lost business profits, arising from use of our website or an order.

For claims arising from a particular order that may lawfully be limited, our total liability will not exceed the total amount you paid for that order.

These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury, death, damage to other property, or any liability or statutory remedy that cannot lawfully be excluded or limited. They do not reduce our obligations to provide refunds or replacements under our Return and Refund Policy.

15. Applicable law and disputes

These terms are governed by California law and applicable federal law. If you are a consumer, this choice of law does not deprive you of mandatory protections that apply where you live.

If a problem arises, please contact info@coffeesearer.com so we can try to resolve it. Contacting us is not a condition of exercising your legal rights. Either party may bring a claim in a court with lawful jurisdiction, including an eligible small-claims court.

16. Changes and general provisions

We may update these terms for future use of our website and future purchases. Changes will not retroactively alter an order already placed. Material changes affecting an existing subscription will be communicated in accordance with the subscription provisions above and applicable law.

These terms, the policies they incorporate, the terms disclosed with your purchase, and any additional written agreement we both accept govern the relevant transaction.

If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. A delay in enforcing a provision does not waive the right to enforce it later.
